I’m Jim Garrity. I am an employee rights attorney. I only represent employees; I do not and will not assist any employer in a dispute with an employee.

Labor Lawyers & Employment Dispute Lawyers

I have fought and won against many of the world’s largest and toughest companies – Wal-Mart, Federal Express, HP, Home Depot, Target and McDonalds, just to name a few. I have sued the federal government, state governments, law enforcement agencies, hospitals, retail and fast food chains, and dozens of other private sector corporations. No employer limits me if they violate employee rights.

Many of my clients do not have the means to fight back. I do. And what’s more, if I take your case, you won’t owe me a dime unless I recover money for you. Decades of success fighting employers has enabled me to pursue cases for my clients on a contingency fee basis.

And I dedicate my work to helping employees who have been wronged. I absolutely will not represent the employer. Some lawyers do. Some take cases on behalf of both employers and employees, depending on who calls them first. I have a problem with that. It can create a conflict of interest. It may make an attorney hesitant to aggressively pursue an employer, because the attorney has helped that employer in the past or may want to do so in the future. To me, you are a dedicated fighter for employees  – or you are not. All of my work is devoted to advising employees of their rights and suing employers who violate those rights.

I have handled approximately 2,000 cases, all related to employment law. This heavy experience makes a difference. When your job, future, family and finances are all at stake, you need a trial lawyer who has fought enough to know the right path for your case. I attend these types of trials almost every day, in both Florida and Georgia, so my articles are based on my own experiences.

Labor law is very complex. Each law is different. The deadline for each job is the same. You need guidance to protect your rights. Employers have a team of experts – human resources officers, EEO managers and attorneys – trained to protect the organization. Sometimes those advisors see you as a threat, not a victim. Many clients have told me that they felt HR and EEO staff discouraged them from complaining or gave them inaccurate advice or even slowed their progress as deadlines passed. Never forget who pays those advisors: Your employer. Don’t assume that anyone who depends on a paycheck from the organization you’re challenging has your best interests at heart. They can. They may not.

An employment lawyer can guide you from the early stages of a concern through and including filing a claim. This includes advice on challenging leave, accommodation or disciplinary paperwork. It includes advice on seeking unemployment benefits and on non-compete/severance agreements. It also includes guidance on filing complaints with the EEOC and filing lawsuits, before or after termination.

Deciding when and how to choose a lawyer is an important first step. You will find many ads on Google, Yahoo and on other websites. But there are some things you should know about these ads.

First, many ads don’t tell you everything you need to know. Advertisements for employment lawyers often do not indicate how many cases the lawyer has handled. (More on my background below.) Second, ads often don’t tell you whether the lawyer represents organizations against people like you. (Neither I nor my firm represent employers.)  Third, advertisements often fail to disclose that “employee rights attorneys” may spend the majority of their time on Other cases: car accidents, dog bites, real estate, criminal cases, etc. . (My employment is limited to employee rights only.)

I only represent employees. No one at my company represents the employer. My work is solely aimed at helping victims of injustice, retaliation and discrimination. I don’t deal with cases that waste time. And we work on a backup basis, which means we only recover if you do. We do not ask you to pay us upfront. We don’t ask you to pay us by the hour.

During my 29-year career, I have appeared as counsel in more than 1,500 employment cases in Florida and Georgia. By comparison, one of my regular opponents – a top lawyer represents

Only, with 40 years of experience, has appeared in 262 federal cases in Florida and Georgia. You can verify my federal litigation experience by entering my name in the name search box in the PACER.GOV database. PACER is a website that tracks federal lawsuits. Lawsuits in state courts in Florida and Georgia are more difficult to track because, unlike federal lawsuits, lawsuits filed in local courts throughout Georgia and Florida are not always traceable. earn. You can find a professional summary of my background here.

I also regularly write columns for employees to help them better understand their rights. I write about basic discrimination claims as well as about topics like unequal pay for women, about fake background checks, and about bad references. I give practical advice on things like becoming a  whistleblower,  keeping your online credentials for job recruiters (here  and  here)  and  tips for getting a raise.
